Lister Collection - Terms and Conditions for the Supply and Purchase of Lister Collection Vehicles
These Terms and Conditions ("Terms") apply to all vehicle sales and reservations made by Lister Collection Limited ("Lister Collection", "we", "our", or "us"). By placing an order or reservation, you ("the Customer", "you") agree to be bound by these Terms.
1. CONTRACT
(a) An order for the sale of a vehicle by Lister Collection at the agreed price ("the Total Ex Works Price") becomes binding only when accepted in writing by Lister Collection.
(b) The order, together with these Terms, constitutes the entire agreement between the parties unless varied by a written document signed by an authorised representative of Lister Collection.
(c) No person other than the parties to the contract shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract.
2. DELIVERY
(a) Lister Collection will use reasonable endeavours to secure an estimated delivery date but will not be liable for any delay beyond its control.
(b) The vehicle may be delivered earlier than the estimated delivery date upon at least 14 days' notice to the Customer.
(c) If the vehicle is not delivered within sixty calendar months of the estimated delivery date, either party may cancel the contract by written notice, whereupon the Customer's deposit will be returned in full and Lister Collection will have no further liability.
(d) Delivery is deemed to have occurred when the vehicle is made available for collection and notice is given to the Customer. Physical delivery (if agreed) will be at the Customer's cost.
(e) Lister Collection may cancel the contract if it becomes unable to complete the vehicle. If any option or accessory cannot be supplied, Lister Collection may substitute a reasonable equivalent or remove it from the order and adjust the price accordingly.
3. PRICE AND PAYMENT
(a) The Customer may not collect or take away the vehicle until the Total Ex Works Price has been paid in full in cleared funds. Time of payment is of the essence.
(b) Payments by cheque must be made at least five banking days before collection. A cheque is not treated as payment until cleared.
(c) Cash payments are limited to a maximum of £5,000 and may only be made on the day of collection, subject to verification.
(d) Where the Customer arranges finance, Lister Collection will not release the vehicle until cleared funds are received from the finance provider.
3A. LISTER COLLECTION RESERVATION DEPOSIT
(a) Customers wishing to reserve a vehicle listed on the Lister Collection website must pay a minimum deposit of £1,000 (or such other amount as specified by Lister Collection). Payment must be made by bank transfer before the vehicle is removed from sale. A Lister Collection order form must also be signed and returned before the vehicle is removed from advertising platforms.
(b) Upon receipt of the deposit & order form, Lister Collection will commence any agreed preparation works, which may include but are not limited to service, MOT, mechanical inspection, detailing, cosmetic refurbishment, paint correction, or application of paint protection film.
(c) If the Customer chooses not to proceed with the purchase after preparation work has commenced, the cost of that work will be deducted from the deposit and the balance (if any) refunded.
(d) If the Customer does not complete the purchase within 35 days of paying the deposit, Lister Collection reserves the right to retain the deposit in full and relist the vehicle for sale.
(e) The reservation deposit does not guarantee delivery until a full purchase order has been accepted by Lister Collection and the remaining balance has been paid.
4. FAILURE TO COLLECT
If the Customer fails to collect or pay for the vehicle within 14 days of the delivery date, Lister Collection may store the vehicle at the Customer's cost or, after giving seven days' written notice, treat the contract as cancelled. In such case, any sums paid will be refunded less 10% of the Total Ex Works Price and any losses, expenses, or storage costs incurred.
5. WARRANTY
(a) Every Lister Collection vehicle is supplied with a Lister Collection Warranty, which provides cover for certain mechanical and electrical components for a specified duration and mileage.

(c) All warranty work must be authorised in advance and carried out by a repairer approved by Lister Collection.
(d) The warranty does not affect your statutory rights under consumer law.
6. EXAMINATION AND RELIANCE
(a) Before signing the delivery form, the Customer must inspect the vehicle. As Lister Collection vehicles are often hand-built or restored, minor variations may exist, and the statutory condition of satisfactory quality does not apply to defects apparent on reasonable inspection.
(b) The Customer confirms that they have satisfied themselves as to the suitability of the vehicle for their intended purpose and have not relied on Lister Collection's skill or judgement.
7. CLAIMS
Where a valid claim is made for defects in materials or workmanship, Lister Collection may, at its sole discretion, repair or replace the affected part or refund a reasonable proportion of the purchase price. Beyond this, Lister Collection shall have no further liability.
8. SALE TO INTERMEDIARIES
The Customer confirms they are not purchasing the vehicle as an intermediary or reseller unless agreed otherwise in writing.
9. RETENTION OF TITLE
Ownership of the vehicle remains with Lister Collection until payment is received in full. Until that time, the Customer must keep the vehicle insured and identifiable as Lister Collection's property and must not sell or charge it.
10. CANCELLATION
(a) Except as required by law, no order accepted by Lister Collection may be cancelled without written agreement. The deposit will be forfeited and Lister Collection may recover any additional losses.
(b) If the vehicle has been designed, modified or personalised to the Customer's specification, the right to cancel does not apply.
11. DEFECTIVE GOODS
Claims relating to defects on delivery must be notified to Lister Collection within 14 days of collection, or within a reasonable time of discovery if not apparent at delivery.
12. LIABILITY
Except in cases of death or personal injury caused by Lister Collection's negligence, Lister Collection shall not be liable for indirect or consequential loss, loss of profit, business, goodwill, or disappointment arising from the contract.
13. TERMINATION
Lister Collection may cancel the contract or suspend delivery if the Customer becomes insolvent, fails to make payment, or breaches these Terms.
14. DATA
Lister Collection will process Customer data in accordance with UK data protection laws and may use it to provide updates, offers, and information relevant to its products and services.
15. NOTICES
Any notice under these Terms may be given in writing or by email to the last known address of the other party and shall be deemed received on the day of delivery or transmission.
16. GOVERNING LAW
This agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
